Right of Way Clearance
Each Transportation Enhancement (TE) project is required to have right-of-way clearance before it goes to bid advertisement.
For a vast majority of Transportation Enhancement Projects, most right-of-way and easements take place on government land. A small minority of TE projects require right-of-way from private parcels.
If the right-of-way or easement takes place on public land, the project sponsor needs approval from the land owners to do the project. A Joint Project Agreement can fulfill this approval function, and may set the basis for the right-of-way clearance memo.
On private land, the clearance requires that the
sponsor acquire the property per federal standards,
or obtain an easement, for the TE project. The Right-of-Way
Process Overview has more information.
If a sponsor has Certification Acceptance, they get their own right-of-way clearance, and verifies to ADOT that such clearance has been obtained.
