The following Terms and Conditions of Sale govern ADOT's Public Auctions. This information is provided to assist in making your participation in our auctions a troublefree and positive experience.

Notice is hereby given for a Public Auction on May 3, 2008 , beginning at 8:00 AM. Public parking will be available in the ADOT yard at the the southeast corner of Hilton Avenue & 22nd Avenue on the day of the auction. Items will be sold to successful bidders. Successful bidders are urged to read and understand the "Purchase Contract" prior to signing.

BIDDERS ARE ENCOURAGED TO PRE-REGISTER FOR THIS AUCTION AT ANY TIME BY COMPLETING THE REGISTRATION FORM, CALLING 602.712.6505 OR PRE-REGISTER AT TIME OF INSPECTION.

Payment shall be made by cash, money order, certified check, or cashier's check. Checks and money orders shall be made payable to ADOT. Other methods of payment, including personal and company checks will not be accepted. ADOT will begin accepting payments approximately one (1) hour after the auction has concluded. Payments will be accepted until 2:00 P. M. on the day of sale, and on the following Monday, May 5, between 8:00 AM and 2:00 PM. Bidders shall remit payment for all items purchased; partial payments will not be accepted. A $5.00 per day storage fee will be charged for items left over five (5) days.

Six and three-tenths percent (6.3%) Arizona Sales Tax will be added to the selling price of each item. Exception allowed only upon presentation of a valid State Privilege (Sales) License or any State Use License. Bidders claiming "tax exempt" status will be required to provide a copy of State Privilege (Sales) License or Statue Use License at time of Bidder Registration.

All items are sold "As Is Where Is". Deficiencies, when known, will be indicated. However, absence of any indication does not mean the item may not have deficiencies. It is the bidders responsibility to know what they're bidding on. All items should be inspected by a qualified technician prior to operation. The Arizona Department of Transportation reserves the right to withdraw an item at any time and the right to reject any or all bids.

Equipment, irrespective of its location, will be sold on an "as is" basis. Neither the State of Arizona, nor any of its departments or institutions, nor the auctioneer make any guarantee or warranty of any kind, expressed or implied, as to the condition of the article offered for sale.

Pursuant to ARS 28-902, any motor vehicle, painted yellow, owned or operated by the state . . ., shall, if sold or transferred to a private owner, be repainted a different color . . . by such private owner before it may be driven on the public highways of the state.

Per Arizona Administrative Code R2-15-303, Section 5, "An employee of the owning or disposing agency shall not directly or indirectly purchase or agree with another person to purchase surplus property if said employee is or has been, directly or indirectly involved in the purchase, disposal, maintenance, or preparation for sale of the surplus material."
